IMPORTANT: You must be 21 + to access or purchase from this Site. By using the Site, you accept these Terms, our Privacy Policy, and any posted guidelines. If you do not agree, do not use the Site or purchase Products.

  1. PURPOSE & SCOPE

These Terms & Conditions (the “Agreement”) govern all access to https://crookedvines.com and any related apps, services, or content (collectively, the “Site”) provided by Witch’s Brew Tonics and Elixirs LLC (“Crooked Vines,” “we,” “our,” or “us”). This Agreement forms a legally binding contract between Crooked Vines and any individual or entity that views, visits, registers, or purchases Products (“you,” “your,” or “Customer”).

  1. AGE & LEGAL COMPLIANCE

  • You represent that you are at least 21 years old and legally permitted to purchase hemp‑derived THC products in your jurisdiction.

  • You are solely responsible for compliance with all local, state, and federal laws regarding possession, use, and resale of Products.

  1. PRODUCTS WITH HEMP‑DERIVED Δ‑9 THC

Our beverages contain hemp‑derived Delta‑9 THC within federally permissible limits (≤ 0.3 % Δ‑9 THC by dry weight). Keep out of reach of children and animals. Intoxicating effects may be delayed up to two hours. Do not consume while pregnant, nursing, or operating vehicles or machinery.

  1. ORDERING & PAYMENT

  • All prices are listed in U.S. dollars and exclude applicable taxes, shipping, and handling.

  • By submitting an order, you authorize Crooked Vines (or its payment processor) to charge your selected payment method for the total amount.

  • We may accept or reject any order in our sole discretion. Title and risk of loss pass to you when Products are transferred to the carrier.

  1. SHIPPING & DELIVERY

Shipping dates are estimates only; delays do not give you the right to refuse delivery or claim damages. We ship only to states where our Products are lawful.

  1. RETURNS, REFUNDS & DAMAGED OR MISSING DELIVERIES

  • No returns or exchanges on consumable Products, except for shipments returned due to an insufficient address or damage occurring in transit.

  • Dented cans are safe to consume and do not qualify for credit, refund, or replacement.

  • Damaged deliveries:
    · If 3 or more cans in a shipment are punctured or leaking, we will replace the damaged quantity.
    · If fewer than 3 cans are damaged, we will issue a store credit equal to the value of the affected cans (singular cans will not be re‑shipped).

  • Missing items: Contact us within 48 hours of delivery confirmation; we will ship the missing items or issue a credit.

  • Missing deliveries: If a package is marked "delivered," wait 24 hours. If it still has not arrived, notify us for a replacement or full refund.

  • All refund or replacement requests must be submitted to ori.crookedvines@gmail.com within 48 hours of delivery (or of the 24‑hour waiting period for missing packages).

  1. SUBSCRIPTION PLANS & AUTO‑RENEWAL

 

 

Crooked Vines may offer recurring subscription plans (each, a “Subscription”) that deliver Products to you at regular intervals.

  • Automatic Renewal & Billing. By enrolling, you authorize us to charge your chosen payment method at the interval and price displayed during checkout until you cancel. Prices include applicable taxes, shipping, and handling unless stated otherwise.

  • Cancellation. Cancel any time before the next billing date via your online account or by emailing ori.crookedvines@gmail.com. Cancellations received after a charge is processed apply to the following renewal.

  • Changes to Price or Terms. We will give at least 30 days’ notice (email or Site posting) of any material change or price increase. Continued use after effective date constitutes acceptance.

  • Failed Payments. If payment is declined, we may retry, suspend, or cancel your Subscription at our discretion.

  • Trial Offers & Promotions. Any trial period converts to a paid Subscription at the listed rate unless you cancel before the trial ends.

  1. LIMITED WARRANTY

For 30 days after shipment, Products will materially conform to Crooked Vines’ published specifications. Exclusive remedy: replacement or refund, at our option. THE LIMITED WARRANTY IS THE SOLE WARRANTY AND IS PROVIDED “AS IS.”

  1. DISCLAIMERS

EXCEPT FOR THE LIMITED WARRANTY, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY (INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON‑INFRINGEMENT).

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROOKED VINES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. CROOKED VINES’ TOTAL LIABILITY UNDER ANY THEORY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

  1. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Crooked Vines and its owners, officers, employees, and agents from any claim or demand arising out of your (i) breach of this Agreement, (ii) misuse of the Site or Products, or (iii) violation of law or third‑party rights.

  1. INTELLECTUAL PROPERTY

All Site content is owned by Crooked Vines or its licensors and protected by U.S. and international IP laws. You receive a limited, revocable license to access the Site for personal, non‑commercial use.

  1. USER CONDUCT & CONTENT

You may not violate any law, upload harmful material, infringe rights, or interfere with the Site. Any content you submit grants Crooked Vines a perpetual, worldwide, royalty‑free license to use and display that content.

  1. THIRD‑PARTY LINKS & TOOLS

Crooked Vines is not responsible for third‑party sites or tools linked or referenced on the Site.

  1. MODIFICATIONS

We may update this Agreement at any time by posting the revised version. Continued use constitutes acceptance.

  1. GOVERNING LAW & DISPUTE RESOLUTION

  • Governing Law: The laws of the State of New York govern this Agreement, without regard to conflicts‑of‑law rules.

  • Binding Arbitration: Any dispute shall be resolved exclusively by confidential, binding arbitration in Erie, New York under the American Arbitration Association Consumer Rules. Class actions and jury trials are waived.

  • Small‑Claims Exception: Either party may bring an individual claim in small‑claims court within the venue stated above.

  1. SEVERABILITY & ASSIGNMENT

If any provision is invalid, the remainder stays in effect. You may not assign this Agreement; Crooked Vines may assign without restriction.

  1. ENTIRE AGREEMENT

This Agreement, the Privacy Policy, and any posted guidelines constitute the entire agreement between you and Crooked Vines.
